If you attend a MIAM we will fill in the MIAM form together. Try to make sure you bring all the necessary information to your MIAM session.
Referral
Referral to Antworks Family Mediation can be made by you, your legal or financial advisor, or by another advocacy worker or supporter. Referral can be made by telephone or email, email is easiest for us. You or the referrer should complete this Self or Practitioner referral form and email it to helen@antworksfamilymediation.co.uk
Ideally the email should cc in everyone that should know about the referral such as your solicitor, the other party and their solicitor, although we understand this isn’t always possible.
Agreement to Mediate
Following on from the MIAM we hope to move onto the full mediation process if both parties agree. We sign an Agreement to Mediate on commencing mediation to ensure that everyone is fully clear on what they have agreed to do. At Antworks Family Mediation we use plain english where ever possible. You will see that the Agreement to Mediate is written in plain english. We have attached the full version, without plain english applied, at the end of the document for reference. Financial Full Disclosure
In family mediation, when couples are working out financial arrangements, both parties are required to fully and honestly disclose all of their financial circumstances by completing an Open Statement of Financial Information (often referred to as a Form E or financial statement). This is a detailed document in which each person sets out everything relevant to their financial picture — including income, assets, property, savings, pensions, debts, and outgoings. The word “open” means that the information is not confidential and can be shared with solicitors and, if necessary, the court. The purpose is to ensure that any financial agreement reached in mediation is made on a fully informed basis, so that neither party can later claim they did not have a clear picture of the other’s finances. Without this transparency, any agreement could be challenged or set aside at a later stage.
